This course provides an understanding of the legal responsibilities that Oregon public agencies have to the public for highway safety, and how our court systems work to assure that these responsibilities are met. Emphasis will be on practices and procedures that serve to protect the public, public agencies and their personnel. Recent case studies will be presented to define how legal immunities of public officials have changed in Oregon, as a result of the Clarke vs. Oregon court case, and subsequent statutes.
INSTRUCTORS
David Kramer has retired from the Oregon Department of Justice and is currently in private practice in Salem. He’s tried many civil and criminal cases in State and Federal Courts involving matters ranging from highway safety to murder, to racketeering, to negligence to civil rights violations. David is also a colonel in the Air Force Reserve, Judge Advocate General's Corps (retired).
Ed Fischer has been a licensed professional engineer in Oregon since 1980. He has worked in Highway and Transportation Engineering for the Federal Highway Administration, the U.S. Forest Service, and a consulting firm. He retired from the Oregon Department of Transportation in 2010 after 12 years as the State Traffic and Roadway Engineer. He has been called to testify in civil lawsuits against the State and has years of experience in the professional practice of traffic engineering and safety.
